Ex officer was knowingly HIV positive when xesual assault committed, prosecutor says

A former Loveland officer convicted of xesually assaulting a man eight times was HIV-positive at the time of the assault and was aware of his status, according to Hamilton County Prosecutor Joseph T. Deters.

Anthony Pecord, 48, was indicted on one count of felonious assault Wednesday.



If convicted of the felonious assault charge, he faces a maximum sentence of 8 additional years in prison.

The additional charge comes after Pecord was convicted in March of three counts of gross xesual imposition and was sentenced to four years in prison.

Investigators said the 26-year-old victim was unable to consent after Pecord secretly gave him an intoxicant and raped the victim at his home.

"Set aside the fact he's a police officer. He was friends with his victim, rendered them unconscious, and it's, we know definitely, there was more than one person he did this with. There were numerous pictures on his phone and I'm just, frankly, upset that there are people out there that don't know that they may be HIV positive," Deters said.

Hamilton County sheriff's officials said Pecord was a Loveland police officer at the time of the incident.

According to court documents, Pecord allegedly raped the man on Jan. 24 at the man's home in Miami Township.

The prosecutor's office said the man was unconscious.

A Hamilton County Sheriff's Office incident report shows a xesual assault kit was completed at a hospital that same night.

After Pecord was convicted, it was found that he was HIV-positive and was aware of his status before his unlawful xesual conduct with the victim, Deters said.

The victim wasn't aware of Pecord’s HIV status, and did not consent to the xesual conduct with the defendant, according to Deters.

"The victim's been tested, but sometimes the symptoms and they don't show up for sometimes months at a time. So I'm keeping my fingers crossed that everything comes back OK for him. To go through this, go through this type of a rape changes you forever. Add to it that you may now be HIV positive, it's a sickening thing," Deters said.

On Jan. 25, records show Pecord was notified by Loveland city officials that he was under administrative investigation after allegations of xesual assault.

A document dated Jan. 26 showed Pecord signed a document acknowledging he was placed on paid administrative leave.

Officials told him he was to give up his badge, identification and city-issued cellphone.

Loveland city officials said the leave was related to off-duty conduct.

By Feb. 26, Pecord submitted his resignation, according to documents obtained by WLWT.

On March 5, Hamilton County sheriff's officials said Pecord turned himself in.

It didn't appear there were any major issues in Pecord's personnel file, but prosecutors fear there could be more victims following this allegation.

"It's very similar to the rape statute. I mean, it's a very serious crime. He's literally facing years in the penitentiary for this. The reason we, not only indicted him, but went public with this was to see if there's other people out there that need to come forward. For their safety and the safety of their loved ones," Deters said.

Pecord had been a full-time officer with the Loveland Police Department since 2012.

His attorney, Stew Mathews, said he would, "be extremely surprised if there are other alleged victims."

The Hamilton County Prosecutor's Office asks anyone who may have also been a victim of Pecord since 2016 and believes they may have been exposed to call Det. Losekamp at 513-595-7484.

Vile and just disgusting. He should never be released from prison. He's a danger to society.
