FTC Issues Warnings to Stars Who Peddle Products in ‘Stealth Ads’ On Social Media

The Federal Trade Commission issued strong warnings to celebrities and influencers who peddle products on social media in exchange for cash.

The FTC warned celebrities that they must disclose the compensation they receive in return for peddling products on social media such as Instagram or Twitter.com.

According to The Consumerist, the FTC issued warning letters on Friday, April 21, to 90 social media influencers and the brands that pay them to peddle their products.

The report did not disclose who the FTC sent the letters to, but the FTC did provide a template of the letter.
The letters included multiple warnings and reminders about disclosing endorsements to their followers.
“Consumers should be able to notice the disclosure easily, and not have to look for it,” the letter states.
“For example, consumers viewing posts in their Instagram streams on mobile devices typically see only the first three lines of a longer post unless they click ‘more,’ and many consumers may not click ‘more.’ Therefore, you should disclose any material connection above the ‘more’ button.”


“It is often unclear whether an Instagram user is paid to post a product endorsement or if they genuinely use it,” said Kristen Strader, who started a petition to bring the FTC’s attention to the stars’ failure to disclose their relationship with brands.
The Campaign for a Commercial-Free Childhood also issued a statement:
“We’re glad the FTC is encouraging influencers on Instagram to be more forthright, but we hope they expand that initiative to include YouTube and other social media, which reach millions of children and we hope the FTC will take strong action against any influencers who refuse to comply with the rules.”

Basically anyone you have ever seen promote something on Ig.Steph curry,Kevin durant, KKK,even actress like Anne Hathaway . Sometimes they send letters if they think you got paid but its your own product .

Aren't those teas basically just laxatives? And the youtubers usually say they're being compensated when they plug something. And even if they don't it's obvious they are. Seems like a pretty stupid rule.

Saw that coming. They cracked down on online affiliate marketers not too long ago, which was a good thing because some marketers were obviously lying about how much they make online.

Like damn is it really THAT hard to just go to the damn gym and try to eat somewhat healthy? Hell, nowadays you don't even need a gym. You can go jogging outside. And not even that. You can workout in your home with the help of YouTube and apps.

Sometimes I would read tweets from women who used to be on Big Brother (yeah I watch...) and a few of them would be pushing this flat tummy tea. I didn't even know they would be popular enough for anyone to buy it.

The FTC is cracking down on A to Z-list celebrities who hawk products on social media without disclosing the posts are paid endorsements.

[FONT=&amp]In March, the Federal Trade Commission sent nearly 100 letters to stars, brands, and social media influencers (such as NBA vet Allen Iverson) warning them to disclose payments they received in exchange for endorsing products.

[FONT=&amp]The FTC reminded the celebrities that simply saying “thanks” or posting the hashtag #sp for sponsored post was not enough to inform their followers that they were paid for the post.

After Sean Combs posted an Instagram photo promoting AQUAhydrate, the FTC fired off letters to the music mogul Sean Combs c/o his attorney, Jonathan Gardner, in Beverly Hills, CA.

The letter reminded Mr. Combs that, as part owner and director of AQUAhydrate, it is his responsibility to disclose his “material connection” to AQUAhydrate to his followers in “unambiguous language”.

The letter further stated that Mr. Combs should not force his followers to search for the disclosure and that the disclosure should be as clear as the nose on their faces.

Retired pop singer Ciara Wilson gushed about custom sneakers sent to her son, Future Zahir, by luxury footwear designer Buscemi.

But she ran afoul of the FTC when she neglected to mention to her followers that she was paid to endorse the baby shoes.

In separate letters sent to Ciara and her management agency, William Morris Endeavor Ent. in Beverly Hills, the FTC scolded CiCi. “

If there is a “material connection” between you and Buscemi, that connection should be clearly and conspicuously disclosed,” the FTC wrote.

Similar warning letters were sent to Hollywood socialite Amber Rose after she put up a post with a photo of a pinky ring by Fred and Far company.

“Thank you @Fredandfar for your love and support,” Amber Rose wrote in the photo caption. But in its letter, the FTC pointed out that simply saying “thank you” is not sufficient to inform her followers that she was paid to put up a sponsored post.

Popeyes Louisiana Kitchen, Inc., based in Atlanta, regarding reality TV star Kourtney Kardashian who appears to be holding a bucket of Popeyes chicken while chilling on a private jet.
Kourtney’s photo caption reads, “Popeyes on the PJ. #cheatday.”

The FTC sent separate letters to Puma North America, Inc. in Massachusetts and pop star Rihanna that gifting her friends, such as Zendaya Coleman, with Puma x Fenty footwear and clothing in return for shout outs on social media is a no-no.

Zendaya also received a warning letter addressed to her personally after she posted an Instagram picture of pink Puma slides with the caption, “I don’t even wanna wear them they so beautiful [Emojis] @BadGalRiRi @Puma.”


The FTC warned Puma (and Rihanna) that, if there is a business relationship with Zendaya, the relationship should be “clearly and conspicuously disclosed in the endorsements.”

The letter added that consumers should be able to notice the disclosure easily, and not have to look for it.

Akon & Jennifer Lopez received warning letters for peddling Vodka Beluga on social media. A letter also went out to JSG Synergy Group in Moscow, Russia, makers of Vodka Beluga.

Akon and Lopez were paid untold riches to display bottles of Vodka Beluga on their social media pages. What they failed to display were disclosures that they were endorsing the brand for the Russians.

Also on the list of letter recipients are Lindsay Lohan, Heidi Klum, Victoria Beckham, Vanessa Hudgens, Naomi Campbell, Scott Disick, Sophia Bush, Farrah Abraham, Lisa Rinna, Vanessa Lachey, Snooki, and various famous and not-so-famous social media “stars”.

The FTC is not taking any action against the stars who received the letters. Not yet anyway.

Even though it's obvious that these folks are getting paid to post these products, it's good to know that they've been clocked for peddling this garbage.
